Charges brought against Callaway County Sheriff for October arrest

The Randolph County Prosecuting Attorney's Office has charged Callaway County Sheriff Clay Chism with two misdemeanors after an on October 6th arrest in Moberly. Chism was charged on Thursday, November 10th with DWI and resisting/interfering arrest.

Moberly police were called to the Arby's on Highway 24 around 7:40 p.m. for a report of property damage. According to the probable cause statement, Chism was driving his personal vehicle and hit a concrete drive-thru barrier. The statement said parts from Chism's bumper and his front license plate were located near the concrete barrier he had struck.

The statement also says officers who were at the scene found Chism asleep in his truck and said Chism had to be physically shaken to wake up. Officers found a puddle vomit was "still wet" on the ground close to the driver's side door and an alcoholic beverage in the console of the truck. Once awoken, Chism reportedly told officers he was "fine" and "did not need anything." Officers said they observed Chism's speech as slurred and noticed his eyes were watery and bloodshot. The officers also noted they smelled alcohol on Chism, and that his elbow of his sweatshirt had been soaked in vomit, according to the statement. Chism is accused of refusing to get out of the vehicle and then had to be forcibly removed by officers by being placed on the ground. 

When Chism was at the Moberly Police Department building, he allegedly refused to submit a breath or blood test and refused to sign paperwork. The statement says Chism argued he was not driving and refused to answer any questions related to the incident. A gas station employee told officers they saw Chism hit the drive-thru barrier.

Chism could face up to six months in Randolph County Jail and fines if convicted. Chism faces up to a year in jail and a $1,000 fine for the resisting arrest charge. His initial court appearance is set for Monday, November 14th, at 9 a.m. in Randolph County court.
