Judge Linda Hamlett presided over a preliminary hearing for former Eugene Field Elementary gym teacher Katrina Dukes this week. The hearing took place at the Audrain County Courthouse.
"The court found evidence of two things; one probable cause that felony happened (more likely than not, a lesser standard than beyond a reasonable doubt), and two, probable cause that she is the person who committed that crime. This step is how felony cases move to the trial stage. Each felony defendant has an opportunity for this step in the process. Both sides can present evidence, and Judge makes this decision that moves the case forward", said Audrain County prosecuting Jacob Shellabarger.
Dukes is accused of hitting a nine-year-old with a bag of balls, causing bruising and is charged with child abuse or neglect and endangering the welfare of a child.
Mexico School District terminated Dukes' employment in August and she has since filed suit against the District, asking it to reverse its decision.
Her next court date is set for Jan. 6, at 10 a.m.
